City Hall: Action was within by-laws Posted: 10 Jun 2011 06:45 AM PDT KUALA LUMPUR City Hall has refuted allegations made by Bukit Jalil Estate residents that their officers had acted in contempt of court by illegally entering the estate and removing posters and banners put up by the residents. City Hall corporate communications Director Anwar Mohd Zain said his officers were merely following procedures when removing the banners. "The banners and posters were illegal because it contravened City Hall by-laws under the Federal Territory Act 1982 and moreover it was placed on DBKL land. "We never entered the estate nor removed any of the permanent structures as alleged by the residents,'' Anwar said. "It is not right for them to say that we acted in 'contempt' as the case is still pending in court. We have the highest respect for the law and courts which is why we acted by the book following proper procedures,'' he said. Anwar said City Hall had removed 45 banners and posters on May 25 and June 6. The banners were put up on the road outside leading into the estate. DBKL and the estate residents are embroiled in a legal battle after the residents filed an injunction to stop the local authority from demolishing their homes. However, the residents' application was dismissed by the High Court. They filed an appeal and were granted an ex-parte injunction. The case is scheduled for mention on June 16. Khalid: Verdict is clear on status of Subang Ria Park Posted: 10 Jun 2011 06:44 AM PDT Selangor Mentri Besar Tan Sri Khalid Ibrahim said the Appeals Board verdict on the Subang Ria Park case on Tuesday is in line with the state government's view that it is a recreational area but privately-owned. The board had upheld the decision by the Subang Jaya Municipal Council (MPSJ) to reject the planning permission application by developer Sime Darby Property to sub-divide the park and convert part of it from recreational to residential and commercial use, on grounds that it did not comply with the land use zoning of the local plan. The park now remains in its original recreational status. "The verdict had made it clear that the use of the land is only for recreational activities. "The state also respects property rights and if anyone wants to own this piece of property, then acquisition has to be made," Khalid told reporters after the state executive council meeting at the state secretariat building on Wednesday. He said he would continue to recommend the appointed task force, led by Subang Jaya assemblyman Hannah Yeoh, to organise a meeting with Sime Darby Property in ascertaining the value and their capacity in acquiring the park. "The state has already given its commitment to support the Subang Jaya community's intention — discussing with the management of Sime on the acquisition and looking into our capacity of raising the funds," said Khalid. Asked on why the MPSJ Local Plan 2020 was flawed as the board had contended during the judgment, Khalid only said this was a lesson to learn from. "We definitely need to improve, but we are willing to face the people, open up and admit. The state planning committee that gave the approval in principle to the developer to develop 7.7ha (of the 29.39ha) of the park had done it with good intention, because that portion allowable is in exchange for upgrading the entire park. "But the people do not want the development, therefore we have to listen to them," said Khalid. MPSJ president Datuk Asmawi Kasbi said the council was awaiting a written judgment from the board before making any further announcement regarding the park. "We are expecting to receive the letter within a week or two, and will decide on our next course of action after receiving instructions from the board and state planning committee," Asmawi told reporters at the MPSJ building earlier.
