Customer gets full refund for poor quality cabinet material

Posted: 01 Jul 2011 06:53 AM PDT

JOHOR BARU: A contractor's hope for a full aluminium kitchen cabinet in his home was dashed after the services and materials provided by the workmen were not up to par.

The claimant, Tan Kok Huei, said he engaged Classy Kitchen Furniture from Bukit Indah during a home fair here for cabinet installation costing RM2,950.

"I specifically asked for a full aluminium cabinet and stressed that I do not want any wood to be used as there are termites in my house.

"They agreed to do so but after the installation process, I found out that the material for the cabinet's frame was made of synthetic and composite material, which contains timber," he said before the Consumer Claims Tribunal here.

Tan added that the materials used for the cabinet was of bad quality.

"Some of the metal pieces used including the dish basket and frame were rusty and looked old.

"The workmanship was also shoddy as the cabinet did not have a smooth finish," he said, adding that he wanted to claim for a full refund.

The company's representative Daniel Tan said that the material used was called 'Alucobond', a type of composite panel.

"We told the client about the material we will be using and even showed it to him at our showroom," he said.

Tribunal president Maznah Haron then reprimanded Daniel by saying that he had voided the purchase order by providing materials other than aluminium as stated.

"This is also a false representation on your part as the customer clearly wanted aluminium materials to be used and not otherwise," she said.

She also ordered the company to refund RM2,950 to the claimant in 14 days and for the cabinet to be returned to the company.

In another case, Goh Chyng Siew, 37, had filed a complaint against Skill Pest Control for refusing to refund her RM100 deposit.

"When the consultants visited my house to look at the seriousness of the termite problem, they told me that I had to fork out RM1,800 for the service.

"After paying the deposit, I felt something was not right so I called another pest control service to come take a look at the problem and they me the problem was very minor as the termites were only outside the house," she said. She added that the company refused to refund her because it was against their company policy. Maznah then ordered the company to refund RM100 to Goh in 14 days.
